Bring the revision of the coordination rules to a successful conclusion


The European representations of social security institutions from Germany and France call on negotiators and political decision-makers to make full use of the available margin of compromise in order to finally conclude, after more than nine years, the negotiations on the revision of Regulations (EC) No 883/2004 and 987/2009 on the coordination of social security systems.

An agreement has already been reached on major elements such as the cross-border coordination of long-term care benefits, the definition of fraud or a uniform procedure for the social security affiliation of mobile workers among many other topics. A compromise should now be found on a limited number of outstanding issues to adopt a new legislation that will offer a clear and stable framework for companies and citizens. This clear modernised legal framework is necessary to introduce new initiatives, such as the Fair Mobility Package, including the European Social Security Pass (ESSPASS), which will simplify the mobility within the internal market.


In this context and with a view to the present political discussions, the signatories also explicitly want to clarify that the application and certification procedure under the applicable social security law for cross-border employment (“A1 certificate”) must not be merged with the labour law notification procedure for cross-border employment (“posting declaration”). This is also not possible through the e-declaration. These are two entirely distinct procedures with different purposes and addressed to different authorities, falling under two different pieces of legislation: on the one hand, the social security regulations and on the other hand, the posting of workers directive together with the e-declaration regulation proposal.


The adoption of revised coordination regulations is essential to facilitate worker mobility within Europe and to create a secure legal framework as a basis for new mobility initiatives.
